Historic Ruling Eliminates One-Gun-Per-Month Limitation

The nation's most liberal federal appellate court delivered a decisive victory for Second Amendment advocates this Thursday, permanently dismantling California's restrictive "one-gun-per-month" statute.

Court Mandate Makes Ruling Official

Following a June decision where a three-judge panel unanimously supported a lower court's determination, the U.S. Ninth Circuit Court of Appeals has now issued an official mandate making their ruling effective as of August 14. The landmark case, Nguyen v. Bonta, successfully challenged California's 2019 legislation that prohibited citizens from purchasing more than one handgun or semi-automatic centerfire rifle within any 30-day timeframe.

State Abandons Defense of Controversial Law

California officials had until August 6 to file for a case rehearing but chose not to pursue further legal action, essentially conceding defeat on the disputed legislation. This lack of response from the state effectively sealed the fate of the gun rationing measure.

Legal Challenge and Supporting Organizations

Plaintiffs and Advocacy Groups Unite

The legal challenge was initiated by six individual plaintiffs and received substantial backing from multiple firearms rights organizations, including:

  • Firearms Policy Coalition
  • San Diego County Gun Owners Political Action Committee
  • Second Amendment Foundation

Unprecedented Victory in Liberal Court

Breaking New Ground for Gun Rights

Pro-Second Amendment organizations are celebrating this outcome as a groundbreaking achievement in the typically gun-control-friendly Ninth Circuit.

"Today's mandate issued by the Ninth Circuit marks the first time the court has issued a final decision striking down a law for infringing on the Second Amendment," explained SAF Executive Director Adam Kraut in correspondence with Guns.com.

Historical Context of Previous Cases

Kraut emphasized the significance of this ruling by noting the court's previous pattern: "Between Heller and Bruen, every case heard by a panel which concluded the law was contrary to the Second Amendment was reheard en banc by the court and ultimately upheld. This is a historic victory for Second Amendment rights in the Ninth Circuit and marks a measurable defeat for Governor Newsom and the legislature's attempts to curtail the exercise of the right to keep and bear arms in California."
